Payment:
Payments will be made with the following deductions:
- Credits
- Chargebacks
- Third party fees if payment method requested is other than by check (wire transfer, ePassporte, etc.)
- Flat-Rate Plan: Cancellations of free trials that occur within 48 hours of signup (this almost never happens except in the case of low quality traffic).
WantedList will pay on a monthly payment schedule with a check minimum of $25. Any payment periods under the minimum amount will be automatically carried over to the next payment period, until the minimum check amount is met. All payments will be disbursed in US Dollars.
Restrictions:
Any of the following will result in ALL of your accounts being terminated without payment:
Unauthorized "spam" that directly promotes WantedList, including but not limited to E-mail, Instant Messages, Chatrooms, Newsgroups, ICQ and IRC. All email campaigns must be approved by WantedList. Any forms of advertisement, banners or emails used to promote WantedList that is not available in our campaigns or marketing pages, must be authorized by WantedList.
Promote obscene material or contain content of: Warez, Bestiality, Rape, Child Pornography, or any illegal activity. This includes meta tags, text, links, graphic(s) or any HTML.
Directly or indirectly, linking any material to WantedList which is displayed or transmitted in a way as to constitute harmful matter or indecent communications to minors.
Having any material not fully in compliance with 18 U.S.C. Sec. 2257 et seq.
Having any material which is threatening, abusive, hateful, defamatory, libelous, slanderous, scandalous or injurious to the reputation of any person or entity.
Having any material which constitutes an infringement, misappropriation or violation of any person's intellectual property rights such as copyrights, trademark rights, rights of publicity, patent rights, personal property rights, privacy rights or other rights. The affiliate is held responsible for owning/licensing content on their site.
That you are a person under the age of eighteen (18) years.
Any attempts to mislead or defraud WantedList in any way. This includes, but is not limited to:
Incorrect or incomplete account information
Any sort of mechanism or effort that falsely generates hits or signups, including signups by the webmaster
Hits or signups generated as a requirement to enter or obtain access to goods or services on your (or someone else's) web site
Any webmaster found to have cheated or defrauded any other sponsor.
Sites hosted on free hosts that do not permit adult content.
Any misrepresentation of WantedList's site(s), including but not limited to, misrepresenting the cost of membership, terms of membership, or content contained within our site(s).
Exploitation of our terms and conditions, including but not limited to, instructing the member to signup and cancel is also not permitted in any way, shape or form.
The affiliate acknowledges and agrees that the term of this Agreement is at the will WantedList, and this Agreement and/or the Spank Bank Program may be terminated by WantedList, in its sole and exclusive discretion, at any time, without any advance notice and for whatever reason.
WantedList will register a 1099 for all U.S. domestic entities to whom we issue combined yearly payments of $600.00 or more.
Accounts that are terminated without pay will have a stop placed on all outstanding funds. We reserve the right to alter or modify the Terms and Conditions at any time without prior notice to Webmasters. It is the affiliate's responsibility to refer to this document periodically so that you may be informed of any changes to the Terms and Conditions.
Upon termination of this Agreement the affiliate shall immediately cease using the WantedList name, Spank Bank, Associated Site names, WantedList's marks and remove all Spank Bank and WantedList program banners from the affiliate's site(s).
WantedList's server log files will prevail in determining amount of signups. WantedList will not be held responsible for loss due to downtimes resulting from complications with affiliate's hosting equipment or technical errors. We reserve the right to cancel this Agreement at any time, for any reason, without prior notification.
WantedList Limited Liability and Liquidated Damages:
You acknowledge and agree that under no circumstances shall WantedList, its employees, independent contractors, authors, agents, representatives, assigns and successors be liable to you, or any other person or entity, for any direct or indirect losses, injuries or incidental or consequential damages of any kind (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other incidental or consequential damages or any other pecuniary loss) with regard to any link to any WantedList website, or arising from or in connection with the use of the WantedList Program or Spank Bank materials, or due to any mistakes, omissions, delays, errors, interruptions in the transmission, or receipt of WantedList services, content or program materials, including without limitation any losses due to server problems or due to incorrect placement of HTML.
